In this document, we will refer to SC BIOFY DISTRIBUTION SRL as "we", "Seller" or "Company".

2. Definitions

  • User: Any natural or legal person who accesses, visits or views the content of the Site.

  • Customer/Buyer: The natural person (at least 18 years old) or legal entity who places an Order on the Site and purchases Products.

  • Products and Services: Any product or service listed on the Site, including those mentioned in the Order, to be provided by the Seller to the Customer.

  • Order: An electronic document that acts as a form of communication between the Seller and the Customer through which the Customer transmits to the Seller his intention to purchase Products from the Site.

  • Contract: Represents the distance contract concluded between the Seller and the Customer, without the simultaneous physical presence of the two parties, having as its object the sale-purchase of Products on the Site. The contract is considered concluded at the moment of confirmation of the order by the Seller.

3. Acceptance of Terms and Conditions

By visiting the Site, placing an Order or using our services in any way, you agree to fully and unconditionally comply with these Terms and Conditions. This document represents the legal agreement (Contract) between you and SC BIOFY DISTRIBUTION SRL If you do not agree to these Terms, please do not use this Site.

We reserve the right to update, modify or replace any part of these Terms and Conditions. It is your responsibility to check this page periodically. Your continued use of the Site after the posting of changes constitutes your acceptance of them.

4. Terms of Use of the Online Store

  • By accepting these Terms, you represent that you are at least the legal age of majority (18 years) or that you have the consent of a parent or legal guardian to use this Site.

  • You may not use our Products for any illegal or unauthorized purposes.

  • The transmission of any viruses or codes of a destructive nature is prohibited.

  • Any violation of these Terms will result in the immediate termination of your access to the services.

5. Online Sales Policy

  • Placing an Order: The Customer can place orders by adding the desired Products to the shopping cart, and then completing the order by making the payment through one of the methods expressly indicated. Once added to the cart, a Product is available for purchase to the extent that there is stock available.

  • Order Confirmation: After placing your order, you will receive a confirmation email. The contract is considered concluded only when the Seller explicitly confirms, through a second email, the availability of the products and the shipment of the package.

  • Order Rejection: We reserve the right to refuse any order, for any reason. We may limit or cancel quantities purchased per person, per household, or per order. If we modify or cancel an order, we will attempt to notify you by email or at the telephone number provided.

6. Pricing, Billing and Payment Methods

  • All prices displayed on the Site are expressed in LEI (RON) and excluding VAT (non-VAT payer)

  • Shipping costs are not included in the displayed price and will be specified separately in the shopping cart and on the tax invoice.

  • Prices are subject to change without prior notice. Price changes will not affect orders already confirmed.

  • Payment can be made via: cash on delivery, debit/credit card, Apple Pay and Google Pay

  • The tax invoice will be issued based on the data provided by the Customer and will be sent in electronic format (by email) and/or in physical format, together with the products.

7. Delivery of Products

  • Delivery is made on the territory of Romania, through the partner express courier companies Fan Courier, Nova Post, Sameday .

  • The delivery time is usually 2-4 business days from order confirmation, but may vary depending on product availability and busy periods (e.g. Black Friday, Holidays).

  • The shipping cost is 50 RON.

  • The customer is obliged to check the integrity of the package upon receipt. Any visible damage must be mentioned in the report concluded with the courier agent.

8. Right of Withdrawal (Return Policy)

According to Emergency Ordinance No. 34/2014 on consumer rights in contracts concluded with professionals, the Client (natural person) has the right to withdraw from the Contract, without specifying the reasons, within 14 calendar days .

  • Withdrawal period: Expires after 14 days from the day on which the Customer or a third party, other than the carrier, indicated by the Customer, takes physical possession of the products.

  • Exercise of the right of withdrawal: To exercise this right, you must inform us of your decision to withdraw, using an unequivocal statement, for example, an e-mail to office@artes.ro . You may use the model withdrawal form, but it is not mandatory.

  • Seller's obligations: We will reimburse any sums we have received from you, including the costs of standard delivery, no later than 14 days from the date on which we are informed of your decision. We may postpone the reimbursement until we receive the products back or until you have provided us with proof that you have sent back the products.

  • Customer's obligations: You will return the products without undue delay and, in any event, no later than 14 days from the date on which you communicated your withdrawal to us. The deadline is met if the products are sent back before the expiry of the withdrawal period. 14 days. You will bear the direct cost of returning the products. You are responsible for any diminished value of the products resulting from handling other than that necessary to determine the nature, quality and functioning of the products.


  • Exceptions: Sealed products that cannot be returned for health protection or hygiene reasons and that have been unsealed by the consumer, personalized products, etc. cannot be returned.

9. Guarantees

All products sold on the Site benefit from the legal guarantee of conformity , according to Law no. 449/2003. The guarantee covers the lack of conformity of the product existing at the time of delivery. Any conformity problem must be reported within a maximum of two months from the date of discovery.

In addition to the legal warranty, some products may benefit from an additional commercial warranty , offered by the manufacturer. Its conditions are specified in the product documentation.

10. Liability

  • The Seller cannot be held liable for damages of any kind that the Customer or any third party may suffer as a result of the Seller's performance of any of its obligations under the Order and for damages resulting from the use of the Products after delivery.

  • The information presented on the Site is for informational purposes only and is provided in good faith. We are not responsible for any errors (typographical, pricing, stock, etc.) that may appear on the Site. We reserve the right to cancel orders containing products with incorrect prices or characteristics.

11. Processing of Personal Data (GDPR)

We respect the confidentiality of your data. The transmission of personal information is governed by our Privacy Policy . 12. Intellectual Property Rights

The content of the Site (texts, images, graphics, logos, source code, etc.) is the property of SC BIOFY DISTRIBUTION SRL and/or its partners and is protected by copyright and intellectual property laws. Any unauthorized use of this content is prohibited and punishable by law.

13. Force Majeure

Neither party shall be liable for failure to perform its contractual obligations if such failure to perform on time and/or properly, in whole or in part, is due to a force majeure event. Force majeure is an unforeseeable event, beyond the control of the parties and which cannot be avoided.


1 4. Applicable Law and Dispute Resolution


  • This Agreement is governed by and construed in accordance with the laws of Romania.

  • Any dispute arising between the Customer and the Seller will be resolved amicably. If this is not possible, the dispute will be resolved by the competent courts of Iași County.

  • We inform you that you also have alternative dispute resolution mechanisms at your disposal. You can contact the National Authority for Consumer Protection (ANPC).

  • The European Commission also provides the SOL (Online Dispute Resolution) platform, an online tool for the out-of-court resolution of disputes arising from online transactions, available at: https://ec.europa.eu/consumers/odr .
