Throughout this document, S.C. BIOFY DISTRIBUTION S.R.L. will be referred to as “we”, “the Seller”, or “the Company”.

2. Definitions

User: Any individual or legal entity who accesses or views the content of the Site.

Customer/Buyer: Any individual (aged at least 18) or legal entity placing an Order on the Site and purchasing Products.

Products and Services: Any product or service listed on the Site, as included in an Order, to be supplied by the Seller to the Customer.

Order: An electronic document representing communication between the Seller and the Customer by which the Customer expresses the intention to purchase Products.

Contract: The distance contract concluded between the Seller and the Customer without the physical presence of both parties, concerning the sale of Products. The Contract is considered valid once the Seller confirms the Order.

3. Acceptance of the Terms and Conditions

By visiting the Site, placing an Order, or using any of our services, you fully accept and agree to these Terms and Conditions. This document constitutes the legal agreement (the “Contract”) between you and S.C. BIOFY DISTRIBUTION S.R.L.

If you do not agree, please stop using the Site.

We reserve the right to update or modify these Terms at any time. It is your responsibility to review this page periodically. Continued use of the Site constitutes acceptance of the updated Terms.

4. Conditions of Use

By accepting these Terms, you confirm that you are of legal age (18+) or that you have the consent of a parent or legal guardian.

You may not use our Products for unlawful or unauthorized purposes.

Transmitting viruses or harmful code is strictly prohibited.

Any violation of the Terms will result in immediate suspension of access to the services.

5. Online Sales Policy

Placing an Order

The Customer may place an Order by adding desired Products to the shopping cart and completing the payment process using the available payment methods. Products remain available for purchase while in stock.

Order Confirmation

After placing an Order, you will receive an email confirmation.
The Contract becomes effective only when the Seller confirms product availability and shipment in a second email.

Order Refusal

We reserve the right to refuse any Order for any reason.
We may limit or cancel quantities purchased per person, household, or order.

In such cases, we will attempt to notify you via email or phone.

6. Pricing, Billing & Payment Methods

Prices displayed on the Site are shown in the currency available at checkout, depending on the Customer’s country or region.

Shipping costs are not included in product prices and will be shown separately at checkout.

Prices may change without prior notice, but changes will not affect confirmed Orders.

Available payment methods include:

  • credit/debit card

  • Apple Pay

  • Google Pay

  • other international payment solutions where available

Invoices are issued based on the Customer’s provided details and sent electronically and/or included in the shipment.

7. Product Delivery

We ship internationally through partnered courier companies.
Delivery times and shipping fees vary depending on the destination country and will be shown at checkout.

Customers are responsible for checking the condition of the parcel upon delivery. Any visible damage must be recorded with the courier at the time of receipt.

8. Withdrawal & Returns Policy

Customers have the right to withdraw from the Contract within 14 days from receiving the Products, without providing a reason, in accordance with EU consumer protection rules.

Exercising the Right of Withdrawal

To exercise this right, notify us by email at office@artes.ro with a clear statement. You may, but are not required to, use the withdrawal form template.

Seller’s Obligations

We will reimburse all payments received from you, including standard delivery costs, within 14 days from the moment we are informed of your decision.
We may delay the refund until we receive the Products back or until you provide proof of return.

Customer Obligations

You must return the Products within 14 days from notifying us.
You are responsible for return shipping costs.
You are liable for any decrease in value caused by handling beyond what is necessary to establish the nature, characteristics, and functioning of the Products.

Exceptions

The following items cannot be returned:

  • sealed items unfit for return due to health or hygiene reasons that were unsealed

  • personalised or custom-made products

  • other exceptions allowed by applicable consumer laws

9. Warranties

All Products sold on the Site benefit from the legal guarantee of conformity.
Some products may include an additional commercial warranty offered by the manufacturer.

10. Liability

The Seller is not liable for damages arising from the improper use of Products after delivery.

Information on the Site is provided in good faith.
We are not responsible for potential errors (e.g., typographical mistakes, stock errors, pricing errors).
We reserve the right to cancel Orders containing incorrect information.

11. Personal Data Processing (GDPR)

We respect your privacy.

12. Intellectual Property Rights

All content on the Site (texts, images, graphics, logos, source code) is the property of S.C. BIOFY DISTRIBUTION S.R.L. or its partners and is protected by intellectual property laws.

Unauthorized use of any content is strictly prohibited.

13. Force Majeure

Neither party is liable for failure to fulfil obligations caused by a force majeure event—an unforeseeable, uncontrollable, and unavoidable situation.

14. Governing Law & Dispute Resolution

This Contract is governed by the laws applicable at the Seller’s registered location.

Any disputes will first be addressed amicably.
If no resolution is reached, disputes will be handled by competent courts in the Seller’s jurisdiction.
